By accessing our website or placing an order, you agree to these Terms & Conditions, together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy.

Nothing in these Terms excludes, restricts or overrides any consumer right or remedy that cannot lawfully be excluded under the laws applicable in your place of residence.

2. Scope of These Terms

These Terms apply to:

  • your use of lomeraliving.com;
  • orders submitted through our website;
  • communications relating to those orders; and
  • products supplied by or on behalf of Lomera Living.

Additional product-specific terms may appear on a product page, including information concerning made-to-order products, customisation, delivery restrictions, assembly or return eligibility. If product-specific terms conflict with these Terms, the product-specific terms will apply to that product to the extent permitted by law.

3. Eligibility and Information You Provide

You must be legally capable of entering into a binding contract to place an order.

You agree to provide current, complete and accurate information, including your name, email address, telephone number, billing address and delivery address.

You are responsible for checking your order and delivery information before submitting it. We are not responsible for delays or additional costs caused by inaccurate or incomplete information, except where the issue results from our error.

4. Products and Product Information

We take reasonable care to describe products accurately and to display current product information. However:

  • colours may appear differently depending on screens, lighting and surroundings;
  • natural materials may vary in colour, grain, texture, veining or pattern;
  • handmade or individually finished products may have minor variations;
  • measurements and weights may be approximate within reasonable manufacturing tolerances; and
  • product packaging, components or minor construction details may change where this does not materially reduce the product’s function or quality.

These characteristics are not necessarily defects. Nothing in this section limits your rights where a product is faulty, damaged, materially different from its description or otherwise non-conforming under applicable law.

Decorative objects or accessories appearing in lifestyle images are not included unless the product description expressly states otherwise.

5. Product Suitability, Measurements and Access

Before ordering, you are responsible for reviewing the product dimensions, packaged dimensions, materials, intended use, assembly requirements and care information.

You should confirm that the product and its packaging can pass safely through all relevant doors, hallways, lifts, stairways and other access points at the delivery address.

6. Prices, Currency and Taxes

Prices are displayed in the currency selected or shown on the website.

Unless clearly stated otherwise, the total displayed at checkout includes applicable import duties, standard customs-clearance charges and taxes associated with standard delivery to the selected destination. A customer receiving an order normally should not be required to pay additional import duties or taxes.

If a carrier or customs authority requests an unexpected payment, contact us before making the payment.

The included-duty arrangement does not cover additional costs arising from circumstances such as:

  • an incorrect or incomplete address;
  • a customer-requested address change;
  • failed delivery or repeated delivery attempts;
  • refusal to accept delivery;
  • storage or redelivery charges;
  • remote-area surcharges; or
  • non-standard delivery services requested by the customer.

Currency conversion rates and charges imposed independently by your bank, card issuer or payment provider are outside our control.

7. Pricing and Website Errors

We may correct typographical errors, inaccurate product information or obvious pricing errors.

If we identify an obvious error before accepting your order, we may contact you to offer the option of proceeding with the corrected information or cancelling the order for a full refund.

We will not knowingly rely on an obvious error to charge a different amount without your agreement.

8. Placing an Order

Submitting an order is an offer to purchase the products shown in your order.

After receiving your order, we may send an automated acknowledgement. This confirms that we received your order but does not necessarily mean that we have accepted it.

Unless applicable law requires otherwise, the contract between you and us is formed when we send an order acceptance or dispatch confirmation, or when we otherwise expressly confirm that the order has been accepted.

Please review all order details carefully before submitting payment.

9. Order Acceptance and Refusal

We may refuse or cancel an order before acceptance for legitimate reasons, including:

  • a product being unavailable;
  • an incorrect price or material product-information error;
  • an unsuccessful payment authorisation;
  • suspected fraud or unauthorised activity;
  • delivery being unavailable or impracticable at the supplied address;
  • applicable legal or trade restrictions; or
  • quantity limits or orders that appear intended for unauthorised resale.

If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled product using the original payment method, subject to applicable law.

10. Payment

Available payment methods are shown at checkout.

By submitting payment details, you confirm that:

  • you are authorised to use the selected payment method;
  • the information supplied is accurate; and
  • the payment provider may authorise or process the transaction.

Payment may be authorised when the order is placed and collected at that time or at another stage disclosed during checkout.

We are not responsible for charges independently imposed by your payment provider, including foreign transaction or currency-conversion fees.

11. Availability, Made-to-Order Products and Processing

All products are subject to availability.

Some products may be made to order, produced in batches or prepared after an order is placed. Relevant processing estimates, customisation details and cancellation limitations should be stated on the product page or communicated before acceptance.

Processing and delivery dates are estimates unless we expressly identify a date as guaranteed. If a material delay occurs, we will provide available information and any cancellation or refund option required by applicable law.

12. Order Changes and Cancellations

Contact us as soon as possible if you wish to change or cancel an order.

We cannot guarantee a change or cancellation once the order has entered production, customisation, packaging, fulfilment or carrier processing.

Your statutory cancellation rights, where applicable, are not affected. Further information appears in our Returns & Refunds Policy.

Made-to-order, clearly personalised or customised products may not qualify for change-of-mind cancellation or return where an applicable legal exception permits this. Any such restriction should be disclosed before purchase.

13. Shipping and Delivery

We deliver to selected destinations using carriers and logistics providers appropriate for the product and destination.

Delivery estimates are not guaranteed unless expressly stated otherwise. International deliveries may be affected by customs processing, carrier capacity, weather, regional restrictions, access conditions and other circumstances outside our reasonable control.

Unless a product page states otherwise, Standard Delivery is made to the first safe and reasonably accessible point at the delivery address. It normally does not include:

  • delivery inside the property;
  • upstairs or room-of-choice delivery;
  • assembly or installation;
  • unpacking; or
  • removal of packaging.

14. Delivery Appointments and Customer Responsibilities

Some deliveries require an appointment. You are responsible for monitoring the email address and telephone number supplied with your order and responding to reasonable carrier communications.

You must ensure that:

  • an authorised person is available where required;
  • the delivery location is safe and reasonably accessible;
  • access restrictions have been disclosed;
  • any required building or lift permission has been arranged; and
  • the packaged product can pass through the available access points.

Additional costs caused by an incorrect address, undisclosed access restriction, missed appointment, refusal, storage, redelivery or customer-requested service may be charged where permitted by law and where the cost was reasonably incurred.

15. Risk and Ownership

For consumer orders, risk of loss or damage passes to you when you, or a person identified by you other than the carrier, takes physical possession of the product, except where applicable law provides otherwise.

If you independently appoint a carrier that was not offered or arranged by us, different risk-transfer rules may apply to the extent permitted by law.

Ownership of a product passes to you after we have received payment in full and the product has been delivered, unless applicable law requires otherwise.

16. Inspection, Damage and Missing Items

Please inspect the exterior packaging and product as soon as reasonably possible after delivery.

If packaging or a product appears damaged, incomplete, defective or incorrect:

  • photograph the packaging, shipping label and affected areas;
  • retain the product and packaging;
  • note visible delivery damage with the carrier where reasonably possible; and
  • contact us promptly with your order number and supporting information.

A failure to report an issue immediately does not remove a mandatory legal right, but prompt notice helps us investigate the delivery and arrange an appropriate solution.

Do not discard, install, repair or alter a reportedly damaged product before receiving instructions where doing so could prevent a reasonable inspection.

17. Returns, Refunds and Exchanges

Returns and refunds are governed by our Returns & Refunds Policy, which forms part of these Terms.

Change-of-mind return requests must generally be submitted within 14 calendar days after delivery. You must obtain written authorisation and return instructions before sending a product.

Do not return a product to its manufacturer, original dispatch point, packaging address or our general contact address unless we have expressly instructed you to do so.

For an authorised change-of-mind return, the customer is generally responsible for appropriate packaging and return transportation costs, where permitted by law and disclosed before purchase.

A reasonable inspection, repackaging or restocking deduction of up to 10% may apply only where permitted by law and where handling beyond what is reasonably necessary has reduced the product’s value or additional work is reasonably required before resale. We will explain any deduction.

No such deduction will be applied merely because a consumer exercised a statutory cancellation right. It will not apply to a confirmed damaged, defective, incomplete or incorrect product.

Nothing in our Returns & Refunds Policy limits any mandatory statutory remedy or legal guarantee.

18. Assembly, Installation, Care and Safe Use

You are responsible for following all supplied assembly, installation, use, care and safety instructions.

Where professional installation or wall fixing is recommended or required, the work should be completed by a suitably qualified person using fixings appropriate for the wall, floor or structure.

Furniture should be used only for its intended purpose. Children should not be permitted to climb on furniture, and products presenting a tip-over risk should be secured appropriately.

We are not responsible for damage caused by misuse, improper assembly, unauthorised modification, unsuitable installation, failure to follow instructions or normal wear and tear, except to the extent that liability cannot lawfully be excluded.

19. Website Use

You may use our website only for lawful personal or legitimate business purposes.

You must not:

  • interfere with the website’s security or operation;
  • introduce malicious code;
  • attempt unauthorised access to accounts, systems or data;
  • scrape or reproduce substantial website content without permission;
  • use the website for fraudulent activity;
  • submit false, misleading or harmful content; or
  • use our brand, images or product content in a way that suggests an unauthorised association.

We may restrict access where reasonably necessary to protect the website, our customers or our legal rights.

Nothing in this section limits our responsibility for providers acting on our behalf where applicable law makes us responsible.

22. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions, eligibility requirements and expiry dates.

Unless stated otherwise:

  • codes cannot be exchanged for cash;
  • only one code may be used per order;
  • codes cannot be applied retrospectively; and
  • promotions may exclude selected products, destinations or delivery services.

We may cancel or correct a promotion affected by an obvious error, fraud or misuse, subject to applicable law.

23. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or breach of mandatory consumer rights.

To the extent permitted by law, we are not liable for:

  • losses that were not reasonably foreseeable when the contract was formed;
  • losses caused by information or instructions supplied incorrectly by the customer;
  • business losses arising from a consumer purchase;
  • loss caused by misuse, unauthorised modification or improper installation; or
  • delay or failure caused by events outside our reasonable control.

Any limitation in these Terms applies only to the fullest extent permitted by the law applicable to you.

24. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including severe weather, natural disasters, carrier disruption, customs delays, port congestion, industrial action, government action, war, civil disorder, epidemic, infrastructure failure or supply-chain interruption.

We will take reasonable steps to reduce the impact and communicate material delays where practicable. Your mandatory rights concerning delayed or undelivered goods remain unaffected.

25. Privacy and Electronic Communications

Our collection and use of personal information are described in our Privacy Policy.

When you place an order, we may send transactional communications necessary to administer the order, including payment, production, delivery, cancellation, return and support messages.

Marketing communications will be sent in accordance with applicable law and the choices available to you.

The version applying to an order is generally the version made available when that order was placed, unless a change must apply by law or you expressly agree otherwise.

Nothing in this section deprives a consumer in the United States, Canada, the United Kingdom, the European Union or another jurisdiction of any mandatory protection or remedy that cannot lawfully be waived.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

29. No Waiver

If we delay or fail to enforce a provision of these Terms, that does not waive our right to enforce it later.

30. Entire Agreement

These Terms, together with the applicable product information, order confirmation, Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy, form the agreement concerning your purchase, subject to any mandatory rights that apply.
